In MED-ARB, the case is first mediated by the Mediator/Arbitrator. If there is an Agreement, it is put in writing, signed by the parties and counsel and the case is reported Settled to the Court by the Mediator/Arbitrator.
If there is no Agreement, the Mediator becomes the Arbitrator to make a Non-Binding Arbitration Award pursuant to the Florida Rules and Statutes pertaining to Non-Binding Arbitration.
If you are ordered to Non-Binding Arbitration, simply call our office and we can explain the procedure to opposing counsel and get their agreement to stipulate to this MED-ARB procedure. Or, if you prefer, we can set up a "plain" Non-Binding Arbitration.
